Official Promotional Rules

A complete copy of these rules can be obtained at the offices of 104.1 KRBE, Cumulus Broadcasting, LLC, 9801 Westheimer, Suite 700, Houston, Texas 77042, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

1.                   No purchase is necessary.

2.                   All entrants must have been a resident of 104.1 KRBE’s broadcast area as determined by Arbitron for a minimum of 30 days prior to the start date of this contest, and be a minimum of 13 years of age by January 14, 2008, however, to be entered into the Grand Prize drawing, the qualifier must be over 21 years old. The Grand Prize winner and those residing in the same household thereof will not be eligible to win another prize from 104.1 KRBE until August 1, 2008. Persons and those who reside in the same household of such that are presently excluded from participating in or winning any KRBE Contest (with a prize valued at $500 or more) for 180 days are not eligible to participate in this contest.  This includes but is not limited to: September/ October/ November/ December 2007 “$1,004 a Day” Direct Mail Contest Winners, Deal or No Deal Fall 2007 Winners who won over $500, and KRBE Cash Clock – December 2007 Winners.

3.                   All contests are open to the general public except for employees, agents, subsidiaries and affiliates of 104.1 KRBE, Cumulus Broadcasting LLC, Atlantic Records, participating sponsors, their immediate families, and household members.

4.                   An individual may win an on-going contest only once per 30 day period unless otherwise specifically stated.  An individual may win other seasonal or one-time contests only once for the duration of the contest.

5.                   Management reserves the right to change the rules at any time.

6.                   The contest will begin on Monday, January 14, 2008, and will run through, Friday, January 18, 2008.

7.                   Listen to 104.1 KRBE Monday, January 14 through Friday, January 18, 2008 between the hours of 7 a.m. and 10 p.m. for the DJ to prompt to call into 713-390-5723.  Provided the designated caller meets all contest criteria and eligibility requirements, that person will instantly win the Matchbox 20 “Exile on Mainstream”CD ($20 value). All winners of the Matchbox 20 “Exile on Mainstream”CD who are over the age of 21 will be entered to win the Grand Prize trip for 2 to Atlanta, GA to see Matchbox 20 in concert on January 28, 2008. Grand Prize winner will be announced by Mat Mitchell on Friday, January 18, 2008, sometime between the hours of 3 – 7 pm.

8.                   The Grand Prize winner must make arrangements with 104.1 KRBE to complete all trip related paperwork, to include but not be limited to, supplemental earnings forms, release forms and eligibility affidavits within 48 hours of notice, of their initial verification as the grand prize winner.   Additionally the grand prizewinner must provide 104.1 KRBE with their driver’s license/state identification card and their original social security card in order to claim the prize.  Failure to do so will result in forfeiture of all prizes related to this contest, and the grand prize will not be re-awarded.  The grand prize trip must be taken between January 26 – January 29, 2008 (final dates determined by Cumulus Broadcasting, LLC).  If the grand prizewinner is unable to travel during this specific time period the winner will forfeit the grand prize and will not receive any additional prize or compensation, and the trip will be not be re-awarded.

9.                    Prizes: Twenty (20), qualifying Matchbox 20 “Exile on Mainstream”CD’s with a minimum value of $20 each. One (1) Grand Prize: a trip for two to Atlanta, Georgia (must take trip between 1/26 – 1/29/08). Sponsor reserves the right, at its sole discretion, to change the dates of the trip up to 14 days prior to the event. Trip components include: roundtrip coach air transportation for two (2) from major U.S. gateway airport nearest the winner's residence to Atlanta, GA, a minimum of two (2)-days/ one (1)-night standard double-occupancy hotel accommodations (one (1) room). Trip must be taken during the time frame determined by Sponsor or prize will be forfeited in its entirety. Winner and guest must both be 21 years of age or older.  Expenses not specified are winner's responsibility.  Winner will be required to present a major credit card upon check-in at hotel to cover any incidental charges not covered by sponsor. Approximate retail value $1,500.00. Actual value will be determined by winner's residence and seasonal rates. Travel and accommodations are subject to availability and certain restrictions; blackout dates may apply. Winner and guests must have valid U.S. government issued ID (license and/or passports) and will be responsible for all necessary travel authorizations and for any travel insurance.

10.               The odds of winning are subject to the number of persons over the age of 21 who have qualified by winning the qualifying Matchbox 20 “Exile on Mainstream”CD. Once all pre-qualifiers have won, there is at most a 1:20 chance of winning the grand prize.

11.               All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize / prizes valued at over $600 will be issued an IRS form 1099 to report their winnings.

12.               All prizes are awarded “as is.”   Gifts are nontransferable and cannot be exchanged.

13.               The station shall not be responsible for the failure of participating sponsors to deliver prizes as promised.

14.               All entrants and winners agree that the station, Cumulus Broadcasting, LLC, Atlantic Records, and their affiliates, shall have no liability and shall be held blameless for any injury, misfortune, or damage to either persons or property insured by entering, participating in, winning, or losing any contest by use or non-use of any prize received.

15.               All prizes must be claimed in person at the station during regular business hours and within ten business days of being contacted for winning prize, excluding holidays.  After such time, ownership of said prize reverts back to the station to be disposed of at their discretion.  The winner then loses all claims and rights to said prize.

16.               Proper identification must be presented to claim prize.  Winners will be asked to fill out a Winner’s Affidavit and Release.

17.               All entry blanks, forms devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of the station to be used, disposed of or destroyed at the discretion of the station or to be given to participating sponsor(s).  Such use including, but not limited to, enrolling entrant in one or more of the station’s listener clubs and sending entrant correspondence and solicitations with regard to such clubs.  Further Cumulus Broadcasting LLC is not responsible for lost, mutilated, illegible, misdirected, late, stolen, incorrect or incomplete entries. 104.1 KRBE and Cumulus Broadcasting are not responsible for any incorrect or inaccurate information entered by website users, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the website.

18.               Neither, Atlantic Records nor Cumulus Broadcasting, LLC, their affiliates or agents is responsible for busy signals due to heavy call volume, poor cellular connections, dropped, unintelligible, or lost phone calls, missing, incomplete, late, or illegible entry forms, incomplete, lost, late, damaged, illegible or misdirected e-mail entries, for technical hardware or software failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission which may limit a user’s ability to participate in the contest.

19.               All entrants and winners agree that the station may broadcast or publish their name, city of residence, photo, video tape, film or any other likeness, including their voice, recorded or live, for any reason the station deems necessary without compensation.  All entrants further agree to hold the station blameless and without liability for such publication, broadcast or use.

20.               104.1 KRBE and Cumulus Broadcasting LLC reserve the right to change any of this promotion and or the promotional elements and, or reserve the right to end a contest at any time without any advanced notice to the public.

21.               104.1 KRBE reserves the right to limit the number of times an individual may enter a contest or drawing.

22.               104.1 KRBE and Cumulus Broadcasting LLC reserve the right to change any of this promotion and or the promotional elements.  Odds of winning are based on the number entries received.
